Terms & Conditions
These Terms of Service ("Terms") cover your use of and access to the sites, services, tools and features (collectively, the "Services") provided by CvFax (together with its officers, directors, employees, agents, subsidiaries and affiliates, “CvFax”). Our Privacy Policy explains what personal information we collect and how it’s used and shared.
By using or accessing the Services, you're agreeing to these Terms and our Privacy Policy (collectively, this “Agreement”). If you're using the Services for person other than you, you're agreeing to this Agreement on behalf of that other person, and represent and warrant that you can do so. If you don’t agree to all the terms in this Agreement, you may not use or access the Services. Please read this Agreement carefully! It includes important information about your legal rights under UK law, and covers areas such as refunds, warranty disclaimers, limitations of liability, resolution of disputes and data protection.
We’ve aimed to make this Agreement fair and clear. Contact us at [email protected] if you have questions.
1. Creating an Account
1.1. Signing Up.
To use the Services, you must first create an account (“Account”). You agree to provide us with accurate, complete and updated information for your Account, including details necessary for CV distribution. We may need to use this information to contact you regarding the service and relevant job market information. You consent to receiving service-related and marketing emails from CvFax and may opt out from marketing emails by following the unsubscribe link or contacting us.
1.2. Staying Safe.
Please safeguard your Account and password. Notify us immediately of any suspected unauthorised use. You're responsible for all activity on your Account. CvFax isn't liable for acts or omissions by you in connection with your Account.
1.3. Eighteen And Older.
By using the Services, you represent that you are at least 18 years old.
2. Your Content (CV, Personal Data)
2.1. Your User Content Stays Yours.
Users provide us with content, including CVs, cover letters, personal and professional details, photos, and other materials (“User Content”). Your User Content remains yours. These Terms grant CvFax only the limited rights necessary to provide, improve, promote (e.g., showcase service effectiveness anonymously), and protect the Services, specifically including distributing your CV and related details as per your instructions.
3. Your Responsibilities
3.1. Only Use Content You’re Allowed To Use.
You represent you own all rights to your User Content (CV, etc.) or have the necessary permissions to legally use, share, and allow us to distribute it via the Services. You confirm that CvFax's use of your User Content as described won't infringe any third-party rights (copyright, privacy, etc.). Do not upload content unless you have the right to do so.
3.2 Your Content and its Accuracy.
Provide truthful and accurate professional details and CV information documenting your genuine accomplishments. CvFax takes no responsibility for consequences arising from you providing false or misleading information which we distribute as part of our service to recruiters and companies, in line with our Privacy Policy.
4. Our Intellectual Property
4.1. CvFax Owns CvFax.
The Services are protected by UK and international intellectual property laws. These Terms don't grant you any right, title or interest in the Services, our trademarks, logos, brand features, or intellectual property. You agree not to modify, translate, or create derivative works of the Services.
4.2. We Can Use Your Feedback For Free.
We welcome feedback, ideas or suggestions (“Feedback”). You agree we may use your Feedback without restriction or obligation to you, even after this Agreement ends.
5. Our Rights
5.1. Important Things We Can Do.
We reserve the right, at any time and in our sole discretion, without liability or notice (except where prohibited by UK law): (a) to change the Services and functionality; (b) restrict access to parts or all of the Services; (c) suspend or discontinue parts or all of the Services; (d) terminate, suspend or restrict your access to the Services or your Account; (e) change eligibility criteria for using the Services.
6. Privacy
Our Privacy Policy explains how we collect, use, share, and protect your personal information in compliance with UK data protection laws (including UK GDPR). By using the Services, you agree to our data practices as set forth in the Privacy Policy.
7. Paid Services And Fees
7.1. Fees.
You access the CV distribution service by paying a one-time fee for your chosen package. Fees are displayed during the purchase process and on your invoice.
7.2. Taxes.
All fees are inclusive of UK VAT where applicable, unless stated otherwise.
7.3. No guarantees of recruiter or employer interviews or offers.
CvFax works to distribute your CV effectively to relevant UK recruiters and companies based on your selections. However, the decision to contact candidates for interviews or make job offers lies solely with those third parties. CvFax takes no responsibility for their decisions or response rates.
7.4. Refunds.
Due to the nature of the service (initiating distribution upon payment), refunds are generally not provided once the service has commenced, except in our sole discretion or where required by UK consumer law (e.g., if the service is not provided as described or with reasonable care and skill).
7.5. Fee Changes.
We may change our fees for future purchases at any time. Prices for services already purchased will not change retroactively.
7.6. Chargebacks.
If you initiate a chargeback with your bank or card provider for fees paid to us (“Chargeback”), we may automatically terminate your Account and access to reports. We encourage you to contact us first at [email protected] to resolve payment issues. We reserve the right to dispute any Chargeback.
7.7. Our Payment Processor.
We use third-party payment processors (e.g., Stripe, PayPal, Razorpay - specific processors may vary) to bill you. Payment processing is subject to the terms and privacy policies of the respective Payment Processor. We do not control and are not liable for the security or performance of the Payment Processor. You agree to pay all charges through the chosen payment method. We reserve the right to correct payment errors.
8. Term And Termination
This Agreement remains in effect until terminated by you or us. You can terminate by ceasing to use the Services and contacting us if you wish your account deleted (subject to data retention policies). We may suspend or terminate the Services or your access at our discretion, subject to UK law. Sections intended to survive termination (e.g., Intellectual Property, Liability Limitations, Dispute Resolution) will do so.
9. Warranty Disclaimers
To the fullest extent permitted by UK law, CvFax provides the Services "as is" without express or implied warranties. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. This does not affect your statutory rights as a consumer under UK law (e.g., that services be provided with reasonable care and skill). CvFax does not warrant the Services will be error-free, meet all your requirements, or guarantee employment outcomes.
10. Limitation Of Liability
To the extent permitted by UK law, CvFax will not be liable for: (a) indirect, special, incidental, exemplary, punitive or consequential damages; (b) loss of profits, revenue, data, or goodwill; (c) damages related to your inability to use the Services; (d) damages related to data loss or corruption; (e) damages related to third-party conduct or content using the Services; (f) damages related to third-party sites accessed via the Services. Nothing in this Agreement limits or excludes our liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law. Our total aggregate liability for claims related to the Services shall not exceed the greater of £20 or the amount you paid CvFax in the 12 months preceding the claim.
11. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless CvFax from damages, losses, and expenses (including reasonable legal fees) arising from: (a) your breach of this Agreement; (b) your User Content (including accuracy issues); (c) your violation of any law or third-party rights.
12. Dispute Resolution
12.1. Informal Resolution.
Before filing a formal claim, you agree to try resolving the dispute informally by emailing [email protected] with a description of your claim. We'll attempt resolution via email or phone. If unresolved within 60 days, either party may initiate formal proceedings.
12.2. Judicial Forum for Disputes.
You and CvFax agree that any judicial proceeding to resolve claims relating to the Services or this Agreement will be brought in the courts of England and Wales, unless otherwise required by mandatory laws in your country of residence within the UK.
12.3. Time for Filing.
Any claim must generally be commenced within statutory limitation periods applicable under English law (typically 6 years for contract claims), unless a shorter period is permitted and specified elsewhere in this Agreement (e.g., specific refund request windows).
12.4. NO CLASS ACTIONS.
You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or class member in a class, consolidated, or representative action. Class actions are not permitted.
13. Additional Terms
13.1. Entire Agreement.
This Agreement (including the Privacy Policy and any other referenced documents) constitutes the entire agreement between you and CvFax regarding the Services, superseding prior agreements. It creates no third-party beneficiary rights.
13.2. Controlling Law.
This Agreement and the Services shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Mandatory consumer protection laws in your UK country of residence remain applicable.
13.3. Waiver, Severability And Assignment.
Our failure to enforce a provision isn't a waiver of our right to do so later. If a provision is found unenforceable, the remaining provisions remain in effect, and an enforceable term reflecting our intent will be substituted. You may not assign your rights under this Agreement; any attempt is void. We may assign our rights to affiliates, subsidiaries, or successors.
13.4. Modifications.
We may modify this Agreement. We'll post the current version on our site. If a change meaningfully reduces your rights, we'll notify you (e.g., via email or in-service notice) reasonably in advance. Modifications don't apply retroactively. By continuing to use the Services after changes take effect, you agree to the modified Agreement. If you disagree, stop using the Services.
13.5. Translation.
This Agreement was written in English (UK). If translated, the English version controls in case of conflict.
13.6. Testimonial Submission.
If you submit a testimonial, you grant us permission and license to use it (whole or part) for marketing. We aren't obligated to use it. We'll identify you by first name, last initial, city, and county/region (e.g., "Sarah K., Manchester, Greater Manchester"). We may correct errors or edit for length/clarity. Do not submit a testimonial if you disagree.
14.6. CV Distribution Service Delivery Time
Our CV Distribution Service Delivery Time is typically between two (2) and thirty (30) days from confirmation of your order. This timeframe is subject to factors like network capacity, internet connectivity, server availability, and other conditions that may affect delivery.
